The Berkeley COVID-19 Emergency Response Ordinance prohibits all evictions in Berkeley with limited exceptions.
The city of Berkeley is still under a local State of Emergency related to the COVID-19 pandemic, with no expiration date currently set. Berkeley’s eviction moratorium remains in place so long as the State of Emergency remains in effect. In addition, on September 30, 2021, the Alameda County Superior Court amended its Emergency Rule 1.8a, which prohibits the filing of any eviction lawsuit unless the landlord alleges that the eviction is allowed under any local ordinance, and/or is necessary to ensure the health and safety of residents or another permitted exception.
