Tenant Protection Ordinance
The City of Berkeley’s Tenant Protection Ordinance prohibits conduct that may coerce a tenant to move out of a rental unit involuntarily.
Prohibited conduct
Passed by City Council in 2017, the Tenant Protection Ordinance (TPO) prohibits illegal evictions through the use of:
- Fraudulent and/or misleading representations
- Intimidating conduct
- Coercive conduct

Notice requirement
The Ordinance requires landlords to give notice to tenants disclosing the existence of the Ordinance’s protections on a form prepared by the city (see below). This disclosure notice must be:
- Given to the tenant at the start of any tenancy beginning after April 2017.
- Included with any eviction notice. Failure to include this notice is a defense to an unlawful detainer (eviction).
