Tenant Protection Ordinance

The City of Berkeley’s Tenant Protection Ordinance prohibits conduct that may coerce a tenant to move out of a rental unit involuntarily.

Prohibited conduct

Passed by City Council in 2017, the Tenant Protection Ordinance (TPO) prohibits illegal evictions through the use of:

  • Fraudulent and/or misleading representations
  • Intimidating conduct
  • Coercive conduct

To learn about all conduct prohibited by the TPO, review Berkeley Municipal Code Sec. 13.79.060.

Notice requirement

The Ordinance requires landlords to give notice to tenants disclosing the existence of the Ordinance’s protections on a form prepared by the city (see below). This disclosure notice must be:

  1. Given to the tenant at the start of any tenancy beginning after April 2017.
  2. Included with any eviction notice. Failure to include this notice is a defense to an unlawful detainer (eviction).
