Guide to Rent Control
A guide for landlords, tenants, property managers, realtors, and potential rental property owners that explains the basics of Berkeley’s rent control law and certain state laws relating to rental housing.
In Berkeley, there are many kinds of rental units, including single-family homes, duplexes, apartment buildings, accessory dwelling units (ADUs), and rooming houses. The Rent Ordinance applies to most of these rental units and establishes four core rights and responsibilities for both tenants and landlords: rent control; registration requirements for property owners; just causes for eviction; and tenant's right to security deposit interest. Depending on the type of coverage your rental unit has under the Rent Ordinance, all four sections may apply to you, only three may apply to you, or none of the above may apply to you.
