Starting September 1, 2023, all evictions allowed under state law and the Good Cause provisions of the Berkeley Rent Stabilization Ordinance may proceed.

Berkeley’s COVID-19 eviction moratorium expired on August 31, 2023, and all state and county moratoriums have expired. This means that there are no remaining additional eviction protections for tenants due to the COVID-19 pandemic. Starting September 1, 2023, a landlord may evict a tenant for any reason permitted by state law or the Good Cause provisions of the Berkeley Rent Stabilization Ordinance. This includes instances where a tenant is unable to pay rent due to COVID-19.
Even though the Moratorium has ended, the Eviction Defense Center (EDC) can assist Berkeley tenants with rent relief due to COVID-19 or other circumstances. Please contact the EDC at (510) 452-4541 and ask for Eric Magaña or Jose Morales.
Landlords and tenants with additional questions regarding eviction laws and procedures may visit the Rent Board’s COVID-19 information page or Eviction page.
